PRIVACY POLICY
Last updated: October 12, 2026
This Privacy Policy explains how Viva Timepiece ("we", "us", or "our") collects, uses, and discloses personal information when you visit www.vivatimepiece.com, make a purchase, create an account, subscribe to our communications, or contact us (collectively, the "Services"). In this policy, "you" refers to customers, visitors, and other individuals who interact with our Services.
1. Personal Information We Collect
Information you provide
We collect information you submit when placing an order, using an account, contacting customer support, or subscribing to marketing communications. This may include:
- Contact information: your name, email address, telephone number, and mailing address.
- Order information: billing and shipping addresses, products purchased, payment confirmation, delivery information, and return or exchange details.
- Account information: information used to create, access, and manage your customer account.
- Support information: messages, photographs, and other information you choose to provide about your order or enquiry.
- Marketing preferences: email and SMS subscription status, consent records, subscription source and date, and unsubscribe requests.
Providing a phone number for delivery or customer support does not subscribe you to SMS marketing. SMS marketing requires a separate, affirmative opt-in.
Information collected automatically
When you use the Services, cookies, pixels, and similar technologies may collect your IP address, approximate location, device and browser information, pages viewed, products viewed, cart and checkout activity, referral information, and interactions with our advertisements or emails. Where required by law, we obtain consent before using non-essential tracking technologies.
Information from service providers
We receive information from providers that support our Services, including Shopify, payment processors such as Stripe, shipping and fulfillment providers, and providers of analytics, fraud prevention, and communications services. Payment providers process payment card details; we receive the payment status and transaction information needed to manage orders rather than full payment card numbers.
2. How We Use Personal Information
We use personal information to:
- Process payments, fulfill orders, arrange delivery, and handle returns, refunds, and exchanges.
- Manage customer accounts and communicate about orders and support requests.
- Detect card testing, payment fraud, automated abuse, and other security threats.
- Maintain and improve our website, products, and customer experience.
- Send marketing communications in accordance with your preferences and applicable law; SMS marketing is sent only with your separate consent.
- Measure advertising performance and provide relevant advertising, subject to applicable consent and opt-out requirements and the SMS exclusions below.
- Maintain business records, comply with legal obligations, and resolve disputes.
Where applicable privacy law requires a legal basis, we process information to perform our contract with you, comply with legal obligations, pursue legitimate interests such as fraud prevention and service improvement, or act on your consent. We rely on consent where required for marketing or non-essential cookies. You may withdraw consent at any time without affecting processing that occurred lawfully before withdrawal.
3. Sms Marketing And Mobile Information
Collection and consent
If you choose to subscribe to Viva Timepiece SMS marketing at checkout or through another opt-in form, we collect your mobile number and a record of your consent. We may also retain message delivery information, interactions with our SMS links, and opt-out records to operate and protect the program.
Your SMS subscription is optional. Consent is not a condition of purchase. A phone number supplied for shipping, an order, or support does not constitute consent to marketing texts. Email marketing consent does not constitute SMS marketing consent.
Use of SMS information
We use SMS subscription information to send the Viva Timepiece marketing messages you agreed to receive, such as offers, product updates, and checkout reminders where permitted. We also use it to manage subscriptions, process opt-outs, keep consent records, and prevent misuse.
No sale or sharing for third-party marketing
Mobile information collected for our SMS program will not be sold, rented, or shared with third parties or affiliates for their marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with third parties for their own use. These exclusions apply to all disclosures described elsewhere in this Privacy Policy, including disclosures to advertising partners, affiliates, and in connection with a business transaction.
SMS service providers
We may disclose the limited information necessary to Shopify Messaging, messaging delivery providers, telecommunications carriers, and subcontractors that support our SMS program solely to deliver messages, manage consent and subscriptions, process opt-outs, secure the service, and meet applicable legal obligations on our behalf. These providers are not authorized by us to use SMS subscription information for their own marketing or promotional purposes. We may disclose information where legally required.
Storage and retention
SMS information is stored in the systems used to operate our messaging program, with access limited to personnel and providers who need it for the purposes described above. We retain subscription information while needed to operate the program. After you unsubscribe, we may retain consent and suppression records as needed to demonstrate compliance and prevent further marketing messages, subject to applicable law.
Your choices
You may opt out of SMS marketing at any time by replying STOP to a marketing message. You may receive a confirmation of your unsubscribe request. For assistance, reply HELP where supported or email support@vivatimepiece.com. Message frequency varies. Message and data rates may apply. Unsubscribing from SMS marketing does not cancel an order or automatically unsubscribe you from email marketing.
You can contact us to request access to, correction of, or deletion of your SMS information, subject to applicable legal requirements and permitted retention of consent or suppression records.
4. How We Disclose Personal Information
We disclose personal information where necessary for the following purposes:
- Service providers: Shopify, payment processors, suppliers and fulfillment partners, shipping carriers, hosting providers, customer support tools, and analytics or security providers receive information needed to perform their services. Fulfillment partners and carriers may receive your shipping address and delivery phone number to deliver your order; they do not receive your SMS marketing consent for their own marketing.
- Advertising and measurement: advertising partners, such as Google where used, may receive website activity, device identifiers, purchase events, or other permitted information to measure and provide advertising, subject to applicable consent and opt-out requirements. SMS opt-in data, SMS consent records, and mobile information collected for the SMS program are excluded from these disclosures for advertising or promotional purposes.
- At your direction: we disclose information when you ask us to do so or use a service or integration that requires a disclosure.
- Legal and security purposes: we may disclose information to meet legal obligations, respond to lawful requests, prevent fraud, enforce our terms, or protect the rights and safety of customers and others.
- Business transactions: information may be disclosed as necessary in connection with a proposed or completed restructuring, sale, merger, or similar transaction, subject to applicable law and the SMS restrictions in Section 3. A transaction does not authorize a recipient to use SMS consent for its own marketing.
Some advertising-related disclosures may qualify as a "sale", "sharing", or "targeted advertising" under applicable privacy laws, even when no money is exchanged. You may exercise applicable opt-out rights as described below. These advertising disclosures do not include the SMS subscription information excluded above.
Categories of information disclosed for business purposes may include contact identifiers, order and transaction records, account and support information, internet or device activity, and approximate location. Recipients depend on the service involved and are the categories described in this section. We do not use sensitive personal information to infer characteristics about you.
5. Cookies, Analytics, And Advertising Choices
We use necessary cookies to support functions such as cart operation, checkout, account access, and security. We also use analytics and advertising technologies to understand website performance and measure or personalize advertising, subject to applicable consent requirements.
For information about Shopify cookies, visit https://www.shopify.com/legal/cookies. For information about Shopify's privacy practices, visit https://www.shopify.com/legal/privacy.
You can manage cookies through your browser settings and, where available, the website's privacy preference controls. Blocking necessary cookies may affect checkout or other website functions. Rejecting marketing cookies does not automatically unsubscribe you from email or SMS communications; use the unsubscribe methods for those channels separately.
Where required by applicable law, we treat a supported Global Privacy Control (GPC) signal as a request to opt out of sale, sharing, or targeted advertising for the browser or device sending the signal. Learn more at https://globalprivacycontrol.org. Other browser "Do Not Track" signals are not universally supported. You may also contact support@vivatimepiece.com to exercise applicable privacy choices.
6. Email And Other Communications
You can unsubscribe from promotional emails using the unsubscribe link in those emails. We may continue sending non-promotional communications needed to manage your orders, account, returns, or support requests. SMS marketing preferences are managed separately as described in Section 3.
7. Security And Retention
We use reasonable administrative, technical, and organizational safeguards to protect personal information. No method of transmission or storage is completely secure. Please do not send full payment card details or other unnecessary sensitive information by email or text.
We retain information for as long as necessary for the purposes described in this policy, including order fulfillment, account administration, accounting and legal obligations, fraud prevention, dispute resolution, and maintaining marketing consent or suppression records. Retention periods vary according to the information and applicable requirements.
8. Your Privacy Rights
Depending on where you live and applicable law, you may have the right to:
- Access your personal information and information about our use and disclosure of it.
- Request correction or deletion of personal information.
- Obtain a portable copy of your information.
- Opt out of sale, sharing, or targeted advertising.
- Withdraw consent, object to processing, or request restriction of processing.
- Appeal a denied privacy request where applicable.
- Lodge a complaint with your local data protection authority.
To exercise your rights, email support@vivatimepiece.com. We may verify your identity before responding. Authorized agents may submit requests where permitted by law, subject to verification of their authority. We respond within the time required by applicable law and will not discriminate against you for exercising your rights. Some information may need to be retained to meet legal obligations or other lawful exceptions. To appeal a decision, reply to our response with your appeal request.
9. International Processing
Our store operates from Thailand, and our service providers may process or store information in other countries, including the United States and countries where Shopify and our fulfillment or messaging providers operate. These countries may have different data protection laws. Where required for transfers from the European Economic Area or United Kingdom, we use applicable safeguards, such as approved standard contractual clauses or adequacy decisions.
10. Children'S Privacy
Our Services are intended for a general adult audience and are not directed to children. We do not knowingly collect personal information from children under 13, or a higher age where required by applicable law, or knowingly sell or share the personal information of children under 16. If you believe a child has provided personal information, contact us so we can investigate and take appropriate action.
11. Third-Party Links
Our website may link to external websites or services. Their privacy practices are governed by their own policies. Please review those policies before providing information. A link does not imply endorsement of an external website or its privacy practices.
12. Changes To This Policy
We may update this policy to reflect changes to our Services, practices, or legal requirements. We will post the revised version here and update the "Last updated" date. We will provide additional notice or obtain consent where required by applicable law.
